What Are The Legal Rights of Teachers?

As a teacher, whether you teach in a public or private institution, your rights are largely the same as those of anyone else. A teacher has the right to freedom of expression, academic freedom, freedom of association, freedom of religion, the right to privacy, and freedom of protection against unreasonable discrimination. But the rights of teachers can come into conflict with the rights of students, employers, the parents of students, and society.

Teacher’s Rights: What Your Teacher Education Program May Not Have Told You

Because of the teacher’s responsibility to their students, employers, and society in general- the rights of the teacher can seem unclear in a number of situations. All too often, teachers are left to discover these boundaries on their own. When legal issues arise, teachers may not know where they stand. Where, for example, does your right to self-expression end and the rights of the student, or the institution, begin?

Few teacher education programs offer much in the way of instruction in this area. In today’s contentious political landscape, teachers need to understand key legal issues that are likely to affect the conditions of their employment.

Attorney Douglas Healy has been successfully protecting the rights of his clients for nearly two decades. He serves as counsel to the Joint Missouri Electric Utility Commission and assists municipalities regarding their energy and utility needs. He also represents clients in need of assistance of criminal defense, as well as those who are wrongfully injured due to the negligence of others.

More recently, Douglas has taken notice of the need of teachers to have their rights protected, and the dearth of instruction in education law that teachers suffer from.

Your Rights as An Educator

Teaching is a noble profession and one that no well functioning society can do without. All too often, teachers are caught in the teeth of a system in which they are among the least protected participants. As a teacher, it is imperative that you have a basic understanding of your rights.

Freedom from Discrimination: Age, Sex, Race

The Fourteenth Amendment of the Constitution contains the Equal Protection Clause. This prohibits discrimination based on race, sex, and national origin. Discrimination based on these factors is also prohibited by Title VII of the Civil Rights Act of 1964, which was amended to include educational institutions in 1974. Title IX of the Education Amendments of 1972 prohibits sex discrimination at federally funded educational institutions. Titles VII and IX also forbid sexual harassment in the workplace.

Academic Freedom

Public school teachers enjoy limited freedom to teach without undue restriction on the subject or content of their material. These rights are protected by the First Amendment. Course material must still be relevant, consistent, and adhere to the teacher’s responsibilities to the student. The age and maturity levels of the students are among the factors which affect the teacher’s freedom of discretion.

Freedom of Expression

In Pickering v. Board of Education, the Supreme Court held that the board had wrongfully restricted the First Amendment rights of a teacher to discuss issues of public importance. Based on this case, teachers retain the right to freedom of expression with limitations based on respect for the educational interest of the school and the needs of the students.

Freedom of Association

Like all citizens, teachers have the right to freedom of assembly, the right to associate with whom they please when not on duty, and the right to participate in professional, labor, or other organizations. Exceptions arise when associations interfere with the teacher’s scholastic responsibilities.

Freedom of Religion

Title VII of the Civil Rights Act of 1964 and the First Amendment guard a teacher’s right to be free from religious discrimination. Like the right to freedom of association, a teacher’s expression of his or her religious faith may not directly interfere with the educational needs of students or the needs of the institution. A teacher may, for example, be openly religious. But she or he may not preach any religious doctrine to students at a public institution.

Privacy Rights

A teacher’s right to privacy is the same as that of any other citizen. It ends when the teacher is under reasonable investigation, when conduct interferes with the educational needs of students, is deemed to not exhibit good character, or if the teacher is suspected of having committed a crime.

If you believe your rights as an educator have been violated, you should consult a legal representative who understands your rights and will fight to protect them. How Professors Can Help Their Students Find Funding For College

Many professors see their job as exclusively focused on teaching and research. They often outsource menial tasks of teaching to teaching assistants and other grad students. Instead, professors should focus much more on helping students find funding sources that will allow them to pay for college. These funding sources will help bolster enrollment and greatly aid the job security of a professor over the years.

Learn about funding opportunities

A professor can share information that they have about multiple funding opportunities with students. They can share scholarships or grants that they found online or through conversations with other professors. Many students do not know where to start when researching college. They may be swayed or influenced by potential scams. Professors have years and even decades of experience determining what funding approaches are helpful for students. They are some of the best resources that students have as they look for ways to fund a college degree.

Help students make connections

A professor’s referral may be helpful in pushing a school administrator to fight harder in order to win a student financial aid. Professors may also be able to introduce their students to business leaders who can show them co-op and job training programs that reduce the cost of college. Finally, professors can help a student secure work study programs and other factors that aid in paying for college. A professor can be the advocate that a student needs to stand out among the competition.

Research colleges for graduate school

One of the most important steps in helping students pay for college is to know as much as one can about the graduate schools that an individual may be suited for if they want to continue on with their degree. This knowledge is why professors should spend time researching colleges that are both rigorous and within a student’s potential price range. Knowing about college types and the nature of different colleges can be helpful in determining what colleges a student should even be considering. The question of funding is moot in some instances where the scholarship packages are to colleges that a student should not be bothering with. The same holds true for much more expensive colleges.

A student may come to a professor with a large funding package from a school with a poor history and a chance of closing down. If the school is so insolvent that it closes down two years into a student’s course of study, the large funding package will have not been worth the effort. This information is essential while an individual is in their undergraduate course of study. It may push them in one direction or another surrounding their studies. Professors need to know this kind of information if they hope to provide accurate, honest information to their students.

Conclusion

Professors need to keep students happy while also teaching them the tools they need to learn. One of the best ways to maintain student satisfaction is to reduce the financial burden of college. Reducing that financial burden can be enormously beneficial in retaining students and making them look back on their college days as fondly as possible

Teaching Why Karl Jobst DDS is Successful

I’ve been passionate about teaching all my life and one of things I love to teach about is having passion for something. You can tell a great deal about the passion someone has by studying a business no matter how big or how small. Karl Jobst DDS would be a great example.

If you were to take a look at Karl Jobst DDS, you’ll see he is passionate about others and this is what I always teach my students; other people are the easiest thing to be passionate about. This is why Karl Jobst DDS is a big success!

Teach for Life

All our life we learn things that will be taught to our kids.  If they listen that knowledge will save them from hard learned mistakes that we learned the hard wayuntitled (111) untitled (110) It has been my experience that the young go out of their way to ignore the wisdom of their parents.  Why is it that the youth want to learn the hard way or they just don’t believe their parents.  I think wisdom is hard to teach, it must be learned from personal experience and the youth will need to make their own mistakes. Dana Sibilsky  learned from the school of hard knocks.

Good Teachers

Good teachers are few and far between.  Think back on your school years and try to remember any teacher that inspired you. It is a shame that there are so few.  Most teachers are in it for the money and have no interest in the children beyond what is required.  Some teachers are so bad that they actually hurtimagesFCHDJTKB untitled (43) the children’s chances of making the grades they need to succeed.  If you had more than one inspiring teacher in your life you should consider yourself lucky.  Luigi Wewege  was exposed to more than his share of bad teachers.  Just hope you have better luck with your children’s teachers.

Teaching the Future

untitled (322) untitled (321)The teachers today are molding the future.  The children are more and more being raised by the schools.  If the teachers are good and engaging the students will thrive and do well all their lives. If the teachers are bored and poorly trained they will negatively impact the students for many years forward.  We as a society have not promoted teachers as an important component of a child’s life.  Home schooled children seem to have a leg up in many ways.  If the parent is a good teacher they can give the individual attention the students need to succeed. Home for Life is not the goal for the home schooled child.

Those that can’t Teach

Those that can do and those that can’t teach.  This can be very true but a bit unfair for some teachers.  There are teachers that were born to teachuntitled (135) untitled (134) cant-scare-me.  They have a way of inspiring their students to go beyond their limitations and become the best they can be.  On the other hand there are teachers that have no business teaching.  They are a real problem for our children and should be fired.  In any other profession they would be.  This whole tenure thing has ruined the teaching system.  Joe Olujic is an amazing teacher and should be promoted. Good teachers are hard to find and should be saved.

Considering the Perspective of Students Is a Valuable Exercise for Teachers

Too many teachers forget what it was like to be a student, choosing instead to remember the most recent and successful experiences of their undergraduate and postgraduate work. Most students struggle at some point in their academic career, and those struggles frequently have nothing to do with the concepts they are learning or their ability to responsibly organize their time.

It is helpful for teachers to try to recall their own experiences in elementary school, middle school and high school, to look back at the time spent in a classroom and to truly remember the many difficulties and stresses that school presented on a daily basis. Even the most mundane of students will encounter some situation during the course of their schooling that seems absolutely world-shattering at the moment, and it is frequently the case that teachers will have no real way of knowing what their students are going through. Judging by the most recent Occidental Vacation Club reviews, it appears many students desperately needed a break from the rigors of the classroom.

Teachers who see student behavior – or more likely, misbehavior – through a different lens will be able to relate to these students in a more meaningful way. Most students do not sleep in class out of disrespect for the teacher, nor do they interrupt a lecture out of contempt for their teacher. They do these things because of circumstances that are most often outside of their control, and a considerate teacher who does not view these behaviors as proof of poor character or a lack of academic desire will have better-performing and happier students as a result.

The situation in Baltimore is a good example of the external world influencing students in a way they feel they cannot control. What teachers must understand is that students are affected significantly by events that are nowhere near as newsworthy as rioting or systemic injustice.

Teaching, What it Takes

What does it take to teach?  Well it requires a teacher and a willing student.  Without on or the other learning wont happen.  Parents send their children to school to let the school raise them too often.  The result is a liberal idiotuntitled (15) that will probably become a college professor.  Worse yet a politician.  The teacher can only teach a willing student.  This requires the willingness to pay attention and try to let it sink in.  Some children have such a short attention span that teaching them the conventional way is impossible.  Consolidated Credit is a good way to borrow money for a tutor.
